1. About these terms
These terms govern your use of the ClearLocal website (clearlocal.ie) and our managed website service. By using our website or engaging our services, you agree to these terms. ClearLocal is operated in Ireland.
2. Our service
ClearLocal provides a managed website service for local businesses in Ireland. This includes website design, development, hosting, local SEO setup, and ongoing maintenance for a monthly fee of €99.
3. Free example
We offer a free example website for your business at no cost and with no obligation. You are under no pressure to proceed. The free example remains our property until you subscribe to the service.
4. Pricing and payment
- The service costs €99 per month
- There is no upfront cost or setup fee
- Payment is due monthly in advance
- We reserve the right to adjust pricing with 30 days written notice
5. Cancellation
You may cancel the service at any time. There are no long-term contracts or cancellation fees. Upon cancellation:
- Your website will remain live until the end of your current billing period
- We can transfer your domain name to you upon request
- Your content (text, images you provided) remains yours
- The website design and code remain the property of ClearLocal
6. Content ownership
You own the text, images, and branding materials you provide to us. The website design, code, and any templates created by ClearLocal remain our intellectual property. You are granted a licence to use the website for the duration of your subscription.
If you wish to take full ownership of the website design and code, you may purchase a buyout for a one-off fee equal to 3 times your current monthly plan cost (e.g. €297 on the €99 plan). Upon payment, full rights to the design and code transfer to you.
7. Your responsibilities
- Provide accurate business information for your website
- Ensure any content you provide does not infringe third-party rights
- Respond to reasonable requests for feedback in a timely manner
8. Our responsibilities
- Keep your website live, secure, and performing well
- Apply updates and maintenance as needed
- Respond to support requests within 2 business days
- Handle text and image updates included in your plan
9. Limitation of liability
ClearLocal provides the service "as is." While we strive for 99.9% uptime, we do not guarantee uninterrupted service. We are not liable for indirect losses, lost profits, or damages arising from website downtime, search engine ranking changes, or third-party service failures. Our total liability is limited to the fees paid in the 3 months preceding any claim.
10. Changes to these terms
We may update these terms from time to time. Material changes will be communicated to active subscribers with at least 14 days notice. Continued use of the service after changes take effect constitutes acceptance.
11. Governing law
These terms are governed by and construed in accordance with the laws of Ireland. Any disputes will be subject to the exclusive jurisdiction of the Irish courts.
